Employment contracts & contracts of service

Our contracts are tailor-made to fit our clients’ needs. For employees and other personnel we provide agreements that not only guarantee the minimum safeguards provided by labour law, but which safeguard their rights both during and after employment.

For employers, we aim to secure the protection of their primary concerns and thus emphasise the importance of water-tight confidentiality clauses, data protection, the safeguarding of trade secrets/know-how and the regulation of conflicting employment both during and after termination.

Termination of employment/unfair dismissal claims

Under Maltese law, premature termination of one’s employment can only come about for a good and sufficient cause or for reasons of redundancy. We have assisted various clients in claims of unjustified dismissal / termination of employment and redundancy, both out of court and before the Industrial Tribunal. We have concluded out of court settlements by successfully negotiating compensation or reinstatement.

Transfer of business

Providing assistance in mergers and acquisitions inevitably involves the employees’ continuation of service and their terms of engagement. Being a major asset of any business, the staff’s rights and security of tenure are to be safeguarded in accordance with the Transfer of Business (Protection of Employment) Regulations.
